Welcome to using the 'Roam Bear App' or 'Roam Bear eSIM' or 'Roam Bear Official Website' provided by 'Roam Bear Co., Ltd.' (Unified Business Number: 96777057), hereinafter referred to as 'Roam Bear'. When you submit your information or purchase products provided by Roam Bear, you agree to Roam Bear's Terms of Service and Privacy Policy.
1. Overview
1.1 Terms
Thank you for choosing to use the services provided by Roam Bear. Before beginning use, please read these 'Terms of Service' (hereinafter referred to as 'these Terms'). These Terms cover the scope of what you can use and access, including: Roam Bear eSIM App (iOS platform) provided by Roam Bear, official website (https://www.travelroambear.com) hereinafter referred to as 'this website', and eSIM mobile data service plans based on eSIM technology, hereinafter referred to as 'data plans'.

1.2 Terms Updates
1.2.1 Roam Bear will continuously develop new features or modify existing features to improve user experience. Roam Bear reserves the right to modify these Terms at any time in response to legal requirements, service content updates, or other legitimate reasons. Possible reasons for changes include but are not limited to: complying with legal regulations, reflecting additions or deletions of service features, correcting errors, clarifying terms, or preventing abuse and harm.

1.2.2 You understand and agree that you are responsible for periodically reviewing these Terms to ensure you understand the latest regulations and obligations. For any significant changes that may materially affect your rights and obligations, Roam Bear will provide advance notice through reasonable means such as email or in-app notifications before the changes take effect. Unless otherwise stated, all updated versions of the Terms will take effect from the date of publication on the Roam Bear official website / Roam Bear App.

1.2.3 If you continue to use the Roam Bear official website and Roam Bear App after the updated Terms take effect, it means you have accepted and agreed to be bound by the new Terms. You may also close your account and stop using the Roam Bear official website and Roam Bear App at any time after the updated Terms take effect.

1.3 Using This Service and/or This Website
You confirm that you are at least eighteen (18) years old and possess all the rights and capabilities required to sign these Terms, and agree and undertake to comply with all terms, conditions, obligations, statements, and warranties contained in this service and/or this website.

1.4 These Terms Are Legally Binding on Both Parties
1.4.1 These Terms, when agreed to by you or an individual legally representing you (hereinafter collectively referred to as 'You' or 'User') by creating an account, downloading software, using this service, or expressing agreement in any other electronic manner, constitute a complete and legally binding agreement between you and the Company. When you perform any of the following actions: (i) create a user account or other account for using this service; (ii) download software, or access/use its services and website; (iii) express agreement in any electronic manner, it means you have read, understood, and agreed to be bound by all contents of these Terms.

1.4.2 Accepting these Terms is a prerequisite for your ability to use this service. Please carefully read the entire text of these Terms. If you have any objections to any content of these Terms, or disagree with any provisions, please immediately cease all access and use of the Roam Bear official website, Roam Bear App, and/or services. Anyone who begins using this service is deemed to have read, understood, and fully agreed to all rights, obligations, and agreements contained in these Terms.

1.5 Various Services
1.5.1 The Company sells eSIM data plans and related services (hereinafter referred to as 'this service'). Service activation requires installing an eSIM profile to your compatible device to complete.

1.5.2 In the services and products provided by the Company, the terms 'digital network card', 'network card', 'virtual network card', 'electronic network card', 'eSim', 'eSims', and 'eSIMs' all refer to 'eSIM'.

1.5.3 When you purchase, the specific content of the plan, including data transfer volume and service validity period, will be clearly stated. This service is only provided within the aforementioned specified validity period. After expiration, any remaining unused service volume will automatically become invalid, and any fees already paid will not be refunded.

1.6 Roam Bear
These Terms are operated by 'Roam Bear'. In these Terms, 'Roam Bear', 'we', 'us', 'the Company', or 'our party' all refer to 'Roam Bear'. Roam Bear is a company established under the laws of the Republic of China (Taiwan), with Unified Business Number 96777057.

1.7 Privacy
To learn more about how Roam Bear collects, processes, and uses personal data, please refer to Roam Bear's Privacy Policy.

2. General Services
2.1 Registration Process
2.1.1 You may register as a member of this service on the Roam Bear App.

2.1.2 Registration Data and Third-Party Login: To complete registration, you may use the designated methods of this service or single sign-on functionality from third-party services (such as Apple). When you log in using third-party services, you are deemed to have agreed to and authorized us to access information provided to us by such services based on your privacy settings. You shall ensure: (i) All registration information you provide or authorize us to obtain is complete, accurate, truthful, and kept up-to-date at all times. (ii) Your account (including third-party accounts used for login) is for your personal use only and may not be transferred, lent, or provided to any third party in any form. You shall be fully responsible for the security of your account.

2.1.3 You agree to assume full responsibility for any use and activity under your Roam Bear account, including but not limited to any unauthorized use of your account by third parties. You are responsible for maintaining the confidentiality of your account and restricting access to your account by any third parties.

2.1.4 To ensure the security of your account, please properly secure the third-party login service accounts you provide. If you discover any unauthorized use of your account, you may notify us immediately.

2.2 Service Purchase and Activation
2.2.1 The Company reserves the right to provide certain data plans only to specific countries/regions. You may browse plans through the Roam Bear official website or browse and purchase data plans on the Roam Bear App.

2.2.2 Before purchasing this service, you must have a device that is compatible with eSIM.

2.2.3 After purchase, users must install the eSIM to their device to activate the data plan according to the order settings. Even when the data plan expires or the allowance is exhausted, the downloaded eSIM will remain on the device. Although users may delete the eSIM at any time, it is recommended to keep the eSIM on the device until the data plan is completely exhausted or expires to ensure continued service provision in the future.

2.2.4 To activate this service, users must first download the eSIM and install the relevant data plan. Both procedures require a stable internet connection to proceed. Please note that purchasing data plans at this stage requires payment of network fees.

2.2.5 You may pre-install the eSIM for your purchased data plan through this service at your current location before departure. If your device is not in the country where the data plan was purchased, your pre-installed eSIM will not activate automatically.

2.2.6 When your device with the installed eSIM arrives in the country where you purchased the data plan, you may enable your purchased eSIM in your device settings to officially activate your purchased plan.

2.3 Refund Policy
2.3.1 For unused data plans, if the eSIM has not been installed, or if it has been installed on your device but the data plan has never been activated, you may request a refund through Roam Bear customer service within the activation time limit. However, the Company will charge system and manual processing fees.

2.3.2 If your eSIM has been installed and you have activated the data plan, even if no data is used or usage is minimal, this situation will still be considered as having used the service, and therefore no refund will be provided.

2.3.3 Roam Bear will decide at its own discretion whether to grant you a full or partial refund. Roam Bear provides no guarantee regarding the scope of your refund request.

2.3.4 Roam Bear reserves the right to refuse any form of refund under the following circumstances: (i) Misconduct: If evidence of abusive behavior is found (e.g., repeated refund requests), violation of the Company's terms, or any fraudulent activities related to service use, Roam Bear will reserve the right to refuse any form of refund. (ii) Account terminated: If a user deletes or cancels their account after purchasing a data plan, subsequent refund applications will not be accepted. This is because after account termination, relevant service records can no longer be traced. (iii) Unrelated expenses: For expenses incurred due to other mobile devices, SIM cards not provided by the Company, other telecommunications service providers, phone charges, or any expenditures not directly related to your Roam Bear account, the Company will not provide refunds or any form of compensation.

2.3.5 All refund requests must be submitted within 30 days from the date of data plan purchase. Please note that each data plan has its independent activation period, and once this period expires, no form of refund will be provided.

2.3.6 Refund Processing Procedure: After you submit a qualified refund application, Roam Bear will complete the review and decide whether to approve the refund within five business days. If the application is approved, the actual refund operation will be completed as soon as possible within a reasonable time frame, but no later than thirty days.

2.3.7 Supplementary Terms for Special Activities: When Roam Bear launches any special activities, supplementary terms and differentiated policies may apply. Such regulations aim to prevent any abusive behavior and ensure fairness and order of activities. If there are any inconsistencies between the relevant terms and this refund policy, this refund policy shall prevail as the final basis.

2.4 Service Provision
2.4.1 After you successfully download the eSIM and activate the corresponding data plan, this service will take effect immediately. The validity period of this service will fully comply with the terms clearly specified in the data plan you purchased. This service will automatically terminate when the data plan allowance is exhausted or the specified period expires, whichever occurs first.

2.4.2 All your data usage will be calculated in kbps units with rounding. This service is provided on an 'as is' and 'as available' basis. Roam Bear does not guarantee that the service will not experience any failures, nor does it provide any warranty for network coverage, service quality, or availability. However, the Company will make reasonable efforts to ensure continuous service availability based on its own and/or technical partners' network performance and connectivity availability. If service failures unfortunately occur, Roam Bear will make reasonable efforts to resolve obstacles as quickly as possible after receiving problem reports or proactive detection.

2.4.3 To ensure compliance with Roam Bear's best business interests, we reserve the autonomy to select network operators and technical partners. When you use this service, you are deemed to have explicitly acknowledged and agreed that Roam Bear will disclose and use your personal data with technical partners in accordance with our Privacy Policy to smoothly provide various services.

2.4.4 Roam Bear's open data capacity plans (hereinafter referred to as 'Unlimited Plans') are designed for Roam Bear users' personal high-demand data usage. This explains the fair usage standards for such plans, as well as actions Roam Bear may take to maintain service quality, high-speed data access, network stability, and ensure fair usage for all Roam Bear users (hereinafter referred to as 'Fair Usage Policy'). (i) This service is designed for personal consumer use. Unlimited plans are strictly prohibited for commercial purposes, resale activities, or any form of group sharing. Users who connect computers or other devices through hotspot functionality and transmit large amounts of data, engage in any profit-making activities, or conduct continuous high-traffic usage that may degrade service quality for other Roam Bear users are strictly prohibited. Roam Bear's data services prohibit commercial resale or any form of distribution. (ii) For extreme usage situations, if a user's data consumption is abnormally high (e.g., significantly exceeding the average usage level of 99% of other Roam Bear users) or negatively impacts other users' service experience, Roam Bear reserves the right to intervene as necessary in these few cases. The goal of such intervention measures is to maintain a good experience for Roam Bear users and ensure fair distribution and access to network resources. (iii) For unlimited plan users, the system will allocate 1 GB of full-speed data within each 24-hour period after user activation. Once this 1 GB allowance is exhausted within that 24-hour cycle, subsequent data transmission speeds will be automatically adjusted to 1.25 Mbps. When the current 24-hour cycle ends, new 1 GB full-speed data will become effective for the next 24-hour cycle. (iv) Users are strictly prohibited from using unlimited plans for any of the following scenarios: Large-scale device-to-device data transfer applications. Continuous streaming content playback intended to replace wired broadband services. Any activities that may affect Roam Bear's or its technical partners' network performance, or deteriorate other Roam Bear users' service experience. Excessive sharing through mobile hotspots with multiple devices or users, beyond the scope of reasonable personal occasional use.

2.4.5 Roam Bear reserves the power to monitor data usage patterns and impose regulations or restrictions on any excessive or abnormal usage behavior. To ensure overall service quality, Roam Bear may implement traffic management or speed limitation measures during peak network demand periods or in specific geographical areas. These measures aim to maintain service standards, safeguard overall network performance, and ensure all users have fair access rights. Such measures may include: reducing data transmission speeds, terminating specific rate plan permissions or value-added services, or even suspending users' eSIM services.

2.4.6 Once evidence of abusive behavior or violation of this fair usage policy is discovered, Roam Bear will exercise its rights to take appropriate countermeasures. When an individual user's data usage negatively impacts other users or overall network performance, Roam Bear may exercise full discretion and implement any of the following actions: (i) Temporarily reduce data transmission rates. (ii) Restrict access to services. (iii) Suspend or terminate their services. If a user's data usage significantly exceeds the average level of 99% of Roam Bear platform users, Roam Bear may proactively notify the user and investigate potential violations. Subsequently, we will take further measures, which may include but are not limited to temporarily or permanently suspending their unlimited plan usage rights. It is worth noting that unless there are special circumstances where advance notice cannot be provided (e.g., urgent considerations involving network security or safety), Roam Bear will attempt to proactively contact you when we suspect you have violated this fair usage policy, and provide advance notice before implementing any form of restrictions, constraints, or service interruptions.

2.4.7 Final Terms and Policy Revisions: This fair usage policy is not an exhaustive enumeration of all possible scenarios. Roam Bear reserves the right to revise this policy when necessary. We solemnly urge all unlimited plan users to use services responsibly and avoid any behavior that may adversely affect other users. Any violation of this policy may result in additional service restrictions or interruptions.

2.5 Service Usage Statement During Roaming
When you use this service while roaming, please note that different local laws and regulations may apply; the Company assumes no responsibility for any non-compliant behavior. Additionally, service usage during roaming may incur additional costs and accelerate consumption of your data plan.

2.6 Service Suspension Terms
2.6.1 The Company may temporarily interrupt services due to system upgrades, modifications, or maintenance needs, and will strive to minimize interruption time. When feasible, the Company will provide advance notice through the website, application, or email.

2.6.2 Under the following circumstances, the Company reserves the right to suspend services without prior notice: (i) Violation of service terms: You fail to comply with the usage standards or notification requirements specified in this agreement. (ii) Investigation in progress: During the investigation of your complaints. (iii) Insufficient information provided: You fail to provide necessary information that complies with relevant regulations or operational requirements. (iv) Suspected illegal activities: We have reasonable grounds to suspect that access to services involves fraud or any illegal activities. (v) Following official orders: Must comply with commands from government agencies, regulatory units, or emergency service departments. (vi) Preventing network harm: To prevent damage to the network caused by your actions or account. (vii) Operational security considerations: Out of necessity to maintain service operations, respond to emergencies, or ensure security.

2.7 Monitoring and Information Disclosure
Within the necessary scope of complying with applicable laws, regulations, and government orders, or to protect the interests of the Company and other users, we may monitor your account data and/or service usage; if we have such obligations, we will disclose relevant information.

2.8 User Obligations
You undertake to use all services in accordance with these Terms of Service, and acknowledge that you will be fully responsible for all services, related functions, or any additional functions included in the data plan. You are obligated to properly configure your device to ensure correct service operation, and comply with standards and instructions issued by the Company or device suppliers. You must: (i) Refrain from using this service for any fraudulent, illegal, or abusive communication activities. (ii) Strictly prohibit using this service for any criminal or illegal activities. (iii) Ensure your actions do not interfere with the normal operation of the Company's network. (iv) Avoid transmitting or uploading any content that infringes on third-party intellectual property rights. (v) Use this service for personal use only, prohibiting any commercial transaction activities. (vi) Use all services in accordance with the provisions of these Terms. (vii) Comply with applicable laws and regulations in your country, place of residence, or place of business. (viii) Provide identity verification documents if required.

2.9 Responsibility Attribution Before eSIM Transfer
Before transferring an eSIM to other users, you are obligated to remove it from your device. If this action is not performed, new users will be able to access remaining pre-activated or pre-purchased services.

2.10 Security Standards and Information Communication
You shall comply with reasonable security operating procedures and service standards. The Company may communicate security-related issues and general information through the official website, application, or dedicated email.

2.11 Handling of Lost or Stolen Devices
If a device on which you have activated services is lost or stolen, please notify us immediately. Before we receive formal notification, you will remain responsible for service usage generated on that device. Please send an email to customer-service@travelroambear.com detailing the circumstances of the device loss or theft. Once necessary account verification procedures are completed, we will make every effort to terminate services on the lost or stolen device within 72 hours.

2.12 Content Responsibility Statement
You shall be fully responsible for all content, information, and communications transmitted through this service. You also acknowledge that the Company shall not be liable for any loss, damage, or failure to properly store such transmitted content.


3. Fees and Service Change Statement
3.1 Fees and Payment Terms
You confirm that you are at least eighteen (18) years old and possess all the rights and capabilities required to sign these Terms, and agree and undertake to comply with all terms, conditions, obligations, statements, and warranties contained in this service and/or this website.

3.2 Service and Price Changes
Prices may be adjusted at any time. The Company reserves the right to modify or discontinue this service (or any part or content thereof) without prior notice. The Company shall not be liable to you or any third party for any effects caused by any modifications, price changes, suspension, or discontinuation of services.

4. Payment Terms
4.1 Payment Principles
All services adopt a prepaid system. You agree to pay for any paid services purchased from us, as well as all other related costs generated under your account.

4.2 Payment Methods
To purchase services directly through us, you must provide a currently valid payment method, such as a credit card, debit card, or other available options listed on the website/application. When you provide a payment method, it means you:
4.2.1 Declare that you have the right to use the provided payment method, and all payment information is truthful and accurate.
4.2.2 Authorize us to charge fees to your designated payment method.
4.2.3 Authorize us to collect payment for any paid services you selected at the time of purchase.
4.2.4 You can check your purchase history in your account.

4.3 Fraud Prevention
Roam Bear reserves the right to verify credit card/debit card payments before completing purchases. If you have any questions about payments, please contact us at customer-service@travelroambear.com.

5. Service Termination Terms
5.1 Company's Right to Terminate
If you seriously violate any terms of this agreement, the Company reserves the right to immediately terminate your account and all purchased data plans, and immediately cease providing related services. In such termination situations, all unused data traffic will not be refunded. Additionally, if the Company proactively terminates your account, we also reserve the right to refuse your establishment of new accounts or obtaining services again in any capacity.

5.2 User's Right to Terminate
5.2.1 You may notify the Company at any time to terminate this agreement and revoke your right to use this service in accordance with the provisions of Article 5.2.3 of this agreement.

5.2.2 If your purchased data plan has not been exhausted or expired, and you notify termination because the Company cannot continue to provide services (unrelated to your personal behavior), you may request a proportional refund of the value of unused services. Apart from this, termination under any other circumstances does not constitute grounds for you to obtain a refund.

5.2.3 To terminate services, please send an email from your account-linked email address to customer-service@travelroambear.com, or you may contact our team through official Facebook or official Instagram. The termination process will be initiated after completing account verification.

5.3 Prohibition of Service Use
Once your account is terminated, or your data plan is cancelled, exhausted, or expired, all your permissions to this service, including any additional services (such as security features or other value-added services) that are part of the applicable data plan, will be immediately revoked.

6. Service Disclaimer
We will do our utmost to improve the accuracy and completeness of our services. However, given the complexity of software, it can never be completely free from defects, errors, or flaws. We do not guarantee or represent that services will be completely free of these issues, such as downtime, data loss, data corruption, service delays, errors, outdated information, etc. Despite other provisions in these Terms, we still reserve the right to modify, suspend, or terminate access to services or any features that constitute part of services at any time. Under any circumstances, to the extent permitted by applicable law, we bear no responsibility for these changes.

Under extremely special and limited circumstances, services may occasionally be unavailable due to human, digital, mechanical, telecommunications, software, and other failures. We cannot predict or control when such outages occur, nor can we control their duration. Services, software, and websites are all provided 'as is' and contain all potential errors. We make no representations or warranties regarding the completeness, accuracy, adequacy, suitability, functionality, availability, or operation of services, software, or websites. You acknowledge that we cannot control your use of services, and we do not guarantee the performance or results you may obtain through using services, software, or websites. You will bear all risks and responsibilities for using services, software, or websites, as well as any loss or errors of any data or information.

To the maximum extent permitted by applicable law, we disclaim any form of express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, as well as any warranties arising through the course of dealing, performance, or commercial use. Without limiting the above provisions, we neither guarantee nor represent that your use of services will not infringe upon any third party's rights, nor do we guarantee that services will always be available for your access or use, nor do we guarantee that they will be error-free or uninterrupted.

7. Scope of Liability Statement
Relying on, using, transmitting, or retrieving any data and/or content through the internet inherently involves risks. Therefore, we recommend that you fully understand these potential risks before using this service, website, and applications. Roam Bear assumes no responsibility for any actions arising from its users and/or visitors accessing or using this service, website, applications, and any additional features or characteristics provided by data plans and configured by third parties.

You must bear the full risk of using this service, website, and software entirely on your own. Roam Bear and any of its employees, senior executives, or directors shall not be liable for any direct, indirect, punitive, incidental, special, consequential, or other damages arising from or in any way related to these Terms, or from the use, inability to use, or services, websites, software, or any related features or functions provided in data plans (including but not limited to any form of data or information loss, business loss, profit loss, business interruption, insurance costs, or any other damages). This applies regardless of whether such damages are based on contract, tort, strict liability, or other legal theories, even if we have been advised of the possibility of such damages.

Under any circumstances, Roam Bear's liability amount arising from or related to these Terms shall not exceed the total fees you paid to us within one year prior to the occurrence of such liability events, and shall not include attorney fees or litigation costs, even if any laws or regulations provide otherwise. You understand and acknowledge that the amount of fees you pay to Roam Bear under this agreement adequately reflects the risk allocation specified in these Terms; without the liability limitation clauses contained in this section, Roam Bear would not enter into this agreement with you.

Some jurisdictions restrict or do not allow liability limitations to be set in contracts (e.g., limiting liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, willful misconduct, or gross negligence by one party). Therefore, the corresponding terms of this section may not apply to you. In regions where such liability limitations apply, Roam Bear's liability will be limited only to the maximum extent permitted by relevant applicable laws.

Additionally, we have implemented measures designed to protect the security of this service, website, and applications; however, the internet is inherently not a completely secure network, and regardless of our efforts and intentions, system reliability may still be affected. We also assume no responsibility for unpredictable events such as network attacks, data transmission security vulnerabilities, or performance guarantees regarding data transmission volume and speed. Users are responsible for taking all appropriate measures to protect their own data, software, devices, and systems, particularly to prevent any virus infections transmitted over the internet.

8. Indemnification Terms
8.1 For any claims or demands made by any third party arising from or related to your violation of the terms of this agreement, or violation of any laws or third-party rights, including reasonable attorney fees, you agree to indemnify, defend, and hold harmless Roam Bear and its senior officers, directors, employees, agents, distributors, and licensees at your own expense, and provide defense for them and keep them free from harm.

8.2 Roam Bear shall not be liable for any delays or interruptions in your use of this service, including any damages caused by the circumstances described in these Terms.
